How do I know if I have a case?

There is absolutely no fees or costs to you to call Allen Law Associates to discuss the details of your accident to determine if you have a personal injury case. The following items will assist in determining whether or not you will have a case:

  • What type of injury do you have?
  • Are you seeking medical treatment?
  • Will you incur medical bills or lost wages?
If you do not have a case, or if it would be more economically feasible for you to handle your own case, you can count on us to advise you accordingly.

What is my case worth?

There is no “formula” to determine the value of your case. However, assuming the liability (who was at fault) is clear, the following areas of damage impact the amount of your settlement:

  • Past and Future Medical Bills
  • Past and Future Lost Wages or Earning Capacity
  • Pain and Suffering
  • Permanent injuries – will you fully recover from your injury or continue to have problems?
How long does it take to conclude my case and recover a settlement?

It depends on the nature and extent of the injury and the treatment needed. Obviously, it you are a surgical candidate, the treatment and recovery time will be extended. In all cases, we want to be sure that all aspects of your injury, recovery, past and future medical bills and lost wages are considered. We need to know how your future lifestyle will be affected. However, the average time for a typical personal injury auto case is 4 to 8 months.

What does it mean when you say “No Fees or Costs Unless You Win”?

You will not be responsible to pay for anything unless we are successful in recovering a settlement from the other person or their insurance company.

How does Allen Law Associates, P.A. get paid?

In personal injury cases, we use the Contingency Fee Contract approved by the Florida Bar. If you “win” and recover a settlement, the Contingency Fee Contract allows a percentage of the settlement to be used to pay the attorney fees.

Should I speak with insurance companies or insurance adjusters?

You should first speak with a lawyer. The insurance adjuster will want to take a recorded statement from you to discuss the accident, your injuries and treatment. Remember that the insurance companies and adjusters are more concerned about your claim from their cost perspective, which is not in your best interest. They want to settle your claim as quickly and as cheaply as possible, and they do not want you to retain an attorney. Why do I have to use my insurance company if I was not at fault in the accident?

Regardless of who is at fault in an accident, the legislature designated “no-fault” insurance for injured persons to use their own “PIP” (personal injury protection) benefits to pay for 80% of medical bills and 60% lost wages up to $10,000. However, we can also assist you with your PIP claim (at no fees or costs to you) as well as pursue any additional coverage or policies that may also be applicable to your loss.
