Why do I have to use my insurance company if the accident was not my fault?
Under Florida law,"No-fault" or Personal Injury Protection (PIP) requires that each person use their own insurance company for medical bills and lost wages REGARDLESS of who is at fault in the accident.
Because it is Florida law, your insurance company cannot increase your premium or surcharge your policy for making a PIP claim. This means that your own insurance company pays for 80% - 100% of your medical bills (depending on your coverage), plus 60% of your lost wages up to $10,000.
The at-fault insurance company will be responsible any medical expenses or lost wages (not covered by your own insurance company), plus future expenses, lost wages and pain and suffering.

Why can't I just deal with the insurance company myself and not pay an attorney a portion of my settlement?

What determines if my claim settles or goes to court?
The majority of cases are settled without litigation.
However, it is important that your lawyer have a proven record of trying cases since the insurance company will not
settle the case fairly if they do not believe your attorney will file suit (or go to court).

What does it mean to "file suit," and when or why do we do it?
Filing legal papers or documents at a courthouse is called filing suit.
We do this after all other options have been exhausted during pre-suit and we have thoroughly discussed these options and obtained authorization from you to proceed with filing suit.
Insurance companies are aggressively defending cases these days which is increasing the number of cases in which we need
to file suit. Even once we file suit, most cases (85-90%) settle before an actual trial begins, however, we would
never file suit in a case where we do not intend to take it "all the way" to trial.

What is mediation?
It's a settlement conference or meeting which takes place prior to a case proceeding to trial.
Each side appears with their attorney and before a person known as the mediator. A mediator is another attorney practicing in the community who is certified to be a mediator. Both sides present their case to the mediator who then tries to help the parties compromise to reach a settlement agreeable to both sides. All information at mediation is confidential and cannot be used at trial.

What is a deposition?
Once a lawsuit is filed, a deposition is a sworn statement under oath concerning the issues of the case. It is usually conducted in an attorney's or court reporter's office and a court reporter records all of the testimony which can be used in the trial of the case.
